Douglas R. Rands

Douglas Rands was born in Provo, Utah in 1958. He received his B.S. from Brigham Young University, in Provo, Utah, in 1984. He received his Juris Doctor from J. Reuben Clark School of Law, Brigham Young University, in 1987. Shortly after his graduation from law school, Mr. Rands commenced his legal career as a law clerk for a district court judge in the Second Judicial District for the State of Nevada. Following a one-year clerkship, Mr. Rands joined a local insurance defense law firm while it was in its infancy. After eight years helping his former law firm grow and expand to Las Vegas, Mr. Rands left to start Rands, South, & Gardner. Mr. Rands is admitted to all courts of the States of Nevada and Utah, the United States District Court for the Districts of Nevada and Utah, and the U.S. Court of Appeals for the Ninth and Tenth Circuits.

Mr. Rands’ trial practice includes a wide range of civil litigation matters such as medical and dental malpractice defense, premises liability, general liability, and employment disputes. Mr. Rands’ practice also includes worker’s compensation litigation. Mr. Rands successfully defended a large casino in a landmark worker’s compensation case before the Nevada Supreme Court. Mr. Rands has successfully tried many general and professional liability cases in both state and federal courts. His work in professional liability has included defense of attorneys, physicians, podiatrists, dentists, and realtors. Mr. Rands’s practice also covers ERISA, ADA and other employment-related issues.

Mr. Rands has been a guest lecturer for attorneys and risk managers regarding worker’s compensation issues on behalf of the State Bar of Nevada. Additionally, Mr. Rands has lectured insurance representatives and their insureds on professional liability issues. Mr. Rands’ reported cases include: Riverboat Hotel Casino v. Harold’s Club, 113 Nev. 1025, 944 P.2d 819 (1997); Palmer v. Del Webb’s High Sierra, 108 Nev. 673, 838 P.2d 435 (1992); State of Nevada v. Dist. Ct. (Ducharm), 118 Nev. 609, 55 P.3d 420 (2002); Crowley v. Nevada, 678 F.3d 730 (9th Cir. 2012).

Mr. Rands is a member of the State Bar of Nevada, the Utah State Bar, the Defense Research Institute and the Washoe County Bar Association.
 

 

Brett K. South

Mr. South was born in Jerome, Idaho in 1960. He received his B.S. from Brigham Young University in Provo, Utah in 1984. He received his Juris Doctor, Cum Laude, from J. Reuben Clark School of Law, Brigham Young University in 1988. Mr. South was admitted to the Nevada Bar in 1988. Upon graduation, Mr. South began a one-year clerkship for a district court judge in the Second Judicial District for the State of Nevada. Following his clerkship, Mr. South joined a law firm emphasizing insurance defense litigation. After seven years of successful practice, Mr. South formed Rands, South, & Gardner. Mr. South is admitted to all courts of the State of Nevada, the United States District Court for the District of Nevada, and the U.S. Court of Appeals for the Ninth Circuit.

Mr. South has a substantial and diverse litigation practice, including insurance defense, insurance coverage litigation, premises liability, vehicular negligence, products liability, professional liability defense, civil rights litigation and bad faith claims. Mr. South’s professional liability cases have included defense of physicians, dentists, orthodontists, and architects.  Mr. South has successfully tried many cases in state and federal court.

Mr. South has successfully defended several appeals before the Nevada Supreme Court and the Ninth Circuit Court of Appeals. Mr. South has been appointed by the Nevada Supreme Court and the State Bar of Nevada as a certified arbitrator for the State of Nevada Arbitration Program where he has conducted over 100 arbitrations. Additionally, Mr. South has guest lectured insurance companies and their representatives on general liability issues. Mr. South’s reported cases include: Schroeder v. Ely Municipal Water Dep’t, 112 Nev. 73, 910 P.2d 260 (1996); Bell v. Anderson, 109 Nev. 363, 849 P.2d 350 (1993); Broam v. Bogan, 320 F.3d 1023 (9th Cir.2003).

Mr. South is a member of the State Bar of Nevada, the Defense Research Institute, and the Washoe County Bar Association.
 

 


 

Douglas J. Gardner

Douglas J. Gardner was born in Salt Lake City, Utah in 1962. He received his Bachelor’s Degree at Brigham Young University in Provo, Utah in 1988. He received his Juris Doctor from the University of Wyoming School of Law in 1990. While at the University of Wyoming, Mr. Gardner was selected as a member of the University of Wyoming Law Review and served as the Articles Editor. He also published two Law Review articles.

Following law school, Mr. Gardner began his practice of law working as an insurance claims examiner. He was responsible for general liability claims in Nevada, California, Texas, Utah, Colorado and Florida. After several years as a claims examiner, he joined an insurance defense law firm located in Reno, Nevada. He was selected to open a Las Vegas office for that firm and he has practiced as an insurance defense attorney in Las Vegas since 1992. Mr. Gardner is admitted to all courts of the State of Nevada, Utah and Wyoming, the United States District Courts for the Districts of Nevada, Utah and Wyoming.

Mr. Gardner’s trial practice includes a wide range of civil litigation matters, including construction defect litigation, premises liability, general liability, employment related issues, professional malpractice, automobile claims and employer/employee disputes. Mr. Gardner has had an active trial practice in Nevada and has also successfully argued cases to the Nevada and Wyoming Supreme Courts. Mr. Gardner’s reported cases include: Anderson v. Baltrusaitis, 113 Nev. 963, 944 P.2d 797 (1997); Coblentz v. Union Welfare Fund, 112 Nev. 1161, 925 P.2d 496 (1996).

Mr. Gardner has been selected as a guest lecturer for the Clark and Washoe County Boards of City Inspectors covering topics such as code compliance, construction defects and liability.
